Amendment to Bylows

FOR THE ORGANIZATION OF

KIWANIS INTERNATIONAL - EUROPEAN FEDERATION

Submitted by: the Kiwanis club of Bergamo-Orobico (Italy-San Marino District)

Purpose: replacing the rotation system among districts by an election process at the European Convention for the office of Vice President; determining the conditions for nomination by the district and setting the rules for election in case there is more than one candidate.

Amend the following article as follows:

Art. IX - Presentation Nomination and Election of Officer of the Federation

Section 2. If the District when in demand it doesn't name a candidate for the position of Vice-president, the District loses its turn in the system of rotation. 

Section 3. The candidate coming from the nominating District is accepted by a majority of the two third of the whole Board. If is not accepted, the nominating District is invited to introduce another candidate. 

  Section 4. Transition. 

The following disposition takes place during the administrative year 2003-04: 

" The District Germany covers the position of Chosen President 

" Wd the District Switzerland-Liechtenstein Vice-president's position 

Since October 1° th 2004, the order of rotation for Vice-president of the Federation among the European Districts will be the following: 

1. France-Monaco

2. Austria 

3. Belgium-Lussenburgo 

4. Italy-San Marino  

5. Poland 

6. The Netherlands

7. Iceland-islands Faroes 

8. Czech republic 

9. Norden 

10.Germany 

11.Switzerland-Liechtenstein 

The new Districts are inserted in this list so that to alternate the new districts with the older ones. 

 Section 5. Section 1. The Presentation and confirmation of the President and President Elect and the election of the Vice-president shall be at the annual Convention. The official program of the annual Convention shall indicate the time and place for presentation and confirmation  or election of these Officer. Such time and place shall be subject to change only in accordance  with the rules of Convention procedure. 

Section 6. Section 2. Non later than October 1° ninety (90) days prior  to the date of the annual Convention of the Federation, Secretary of the District in line of succession shall submits to the Secretary of the Federation their selection for the following officers: President Elect and Vice President.

Section 7. Section 3. The President Elect shall be the sole candidate for the office of President. The Vice President shall be the sole candidate for the office of Presidente Elect.

Nothing in this section shall be construed as limiting the right to make further nominations from the floor of the convention for both offices.

  Section 1. Section 4. The European Districts, through their Board or Convention shall nominate  their candidate for the office of Vice-president based  on  the rotation system between the European Districts (Art. IX Sez. 4).

No District shall nominate a candidate unless it has  maintained full district status for three (3) consecutive  years. 

No district shall nominate a candidate for the office of Vice President as long as such district has an elected officer on the European Board, the district governors not included.

The district hosting the European Convention shall not nominate a candidate for office of Vice President.

Section 8. Section 5.  Transition. The following disposition shall apply during the administrative year 2008 – 09

      The district of Belgium-Luxemburg shall occupy the office of President;

      The district of Italy-San Marino shall occupy the office of President Elect;

      The district of the Netherlands shall occupy the office of Vice President.

Section 8. Section 6. No person shall be candidate for any office without the written consent of and the written assurance that said person, if elected, will fulfil the responsabilities pof such office.

 Sections 9. Section 7. Not later than sixty (60) days prior to the date of the annual Convention, the Secretary of the Federation shall mail to all the District Governors, District Secretaries, and Secretaries of Club within the Federation, the  names of the candidates for the office of President, President Elect and Vice-president. A copy of this mailing shall be sent to the Executive Director of the Kiwanis International. 

   Section 10. Section 8. The Secretary of the Federation shall submit to the Convention,   the names of the President and the President Elect  and of the Vice-president for confirmation. 

 Section 9. When the election of the candidate for Vice President becomes the order of business at the annual convention, the Secretary of the Federation shall inform the house of delegates of the nominees and, if there are two (2) or more candidates, a written ballot shall be taken.

 Section 10. A majority of all valid votes cast shall be  necessary for the election of the Vice President. . 

In the event that any ballot cast does not show a  majority for any nominee, the President shall  designate a time and place for further balloting.

Prior to  the second ballot, the nominee having the  lowest vote on  the first ballot shall be dropped;  and on each succeeding ballot,  the same procedure shall be  followed until one nominee shall have received a  majority of all valid votes cast.   

There shall be no voting by proxy or absentee ballots. In case of a tie vote, the candidate having the eldest membership in Kiwanis International shall be considered elected for the office of Vice President.

Section 11.

The Committee on  the Elections shall report promptly  to the Convention the results of balloting,  and the majority of the Committee shall sign the report. After the Committee has so reported, the chairman shall deliver all ballots to the Secretary to be kept for a period of ninety (90) days after the close of the Convention when  the ballots shall be destroyed. 

Emendamento  allo Statuto

Proposto da: Kiwanis Club Bergamo Orobico (Distretto Italia – San Marino)

Scopo: rimpiazzare il sistema di rotazione tra i distretti con un processo elettivo da effettuarsi alla Convention Europea per la carica di Vicepresidente; determinare le condizioni di indicazione di nomina dei distretti e predisporre le norme di elezione in caso vi siano più di un candidato.

Gli emendamenti ai seguenti articoli sono:

 Art. IX – Presentazione Elezione e nomina di Officer della Federazione.

Sezione 2. Se il Distretto quando richiesto non nomina un candidato per la carica di Vicepresidente, il Distretto perde il suo turno nel sistema di rotazione.

Sezione 3. Il candidato proveniente dal Distretto nominante viene accettato da una maggioranza dei due terzi dell’intero Board. Qualora non venga accettato, il Distretto nominante è invitato a presentare un altro candidato.

 Sezione 4. Transizione.

La seguente disposizione si aplica durante l’anno amministrativo 2003-04:

• Il Distretto Germania ricopre la carica di Presidente Eletto
• Wd il Distretto Svizzera-Liechtenstein la carica di Vicepresidente

A far tempo dal 1° ottobre 2004, l’ordine di rotazione per Vicepresidente della Federazione tra i Distretti europei saà il seguente:

1. Francia-Monaco
2. Austria
3. Belgio-Lussenburgo
4. Italia-San Marino
5. Polonia
6. Paesi Bassi
7. Islanda-Isole Faroes
8. Repubblica Ceca
9. Norden
10. Germania
11. Svizzera-Liechtenstein

I nuovi Distretti vengono inseriti in questo elenco in modo da alternare i distretti nuovi con i più vecchi.

Sezione 5. Sezione 1. La presentazione e la conferma del Presidente, e del Presidente Eletto e l’elezione del Vicepresidente si svolgeranno alla Convention Annuale. Il programma ufficiale della Convention annuale indicherà l’ora ed il luogo per la presentazione o l’elezione di questi Officer. Tale ora e luogo sono soggetti a modifica solamente in accordo con le regole di procedura della Convention.

Sezione 6. Sezione 2. Non oltre 90 giorni prima della  data della Convention annuale della Federazione, il Segretario del Distretto in linea di successione sottopone al Segretario della Federazione la scelta fatta per i seguenti  Officers: Presidente Eletto e Vicepresidente.

Sezione 7. Sezione 3. Il Presidente Eletto è il solo candidato per la carica di Presidente. Il Vicepresidente, sarà il solo candidato per la carica di Presidente Eletto.

Nulla potrà essere apposto in questa sezione per limitare il diritto di effettuare ulteriori nomine dalla assemblea dei delegati per entrambe le cariche di questi officers

  Sezione 8. Sezione 4. I Distretti Europei, attraverso i loro Board o Convention, nomineranno i loro candidati per l’ufficio di Vicepresidente secondo la regola del sistema di rotazione tra i Distretti Europei (Art. IX Sez. 4).

Nessun Distretto potrà nominare  un candidato se  non ha mantenuto lo status di  distretto per tre (3) anni consecutivi.

Nessun Distretto potrà nominare un candidato per l’ufficio di Vicepresidente qualora questo distretto abbia un officer eletto nel Board Europeo, esclusi i governatori di distretto

Il Distretto ospitante la Convention Europea non potrà nominare un candidato per la carica di Vicepresidente

Section 8. Sezione 5.  Notma transitoria: Le seguenti disposizioni dovranno applicarsi nel corso dell’anno amministrativo 2008-09

      Il distretto del Belgio-Lussemburgo occuperà la carica di Presidente;

      Il distretto di Italia-San Marino occuperà la carica di Presidente Eletto;

      Il distretto dei Paesi Bassi occuperà la carica di Vice Presidente

Section 8. Sezione 6 Nessuna persona è candidata ad alcuna carica senza il suo consenso scritto e l’assicurazione che detta persona, se eletta, adempierà alle responsabilità di tale carica.

 Sezione 9. Sezione 7. Non più tardi di sessanta (60) giorni prima della data della Convention annuale, il Segretario della Federazione invia a tutti i Governatori di Distretto, Segretari di Distretto e Segretari di Club nell’ambito della Federazione, i nomi dei candidati per la carica di Presidente, di Presidente Eletto e di Vicepresidente. Una copia di questo invio viene spedito all’Executive Director del Kiwanis International.

 Sezione 10. Sezione 8. Il Segretario della Federazione sottopone alla Convention i nomi del Presidente e del Presidente Eletto e del Vicepresidente per la conferma

 Sezione 9. Quando l’elezione del candidato alla carica di Vicepresidente viene posta all’ordine del giorno, il Segretario della Federazione informerà i delegati in ordine alle nomine e, qualora fossero due (2) o più candidati, verrà effettuata  una  votazione  scritta

 Sezione 10. Una maggioranza di tutti i voti validi espressi è necessaria per l’elezione del Vice presidente.

Nel caso in cui nessuna votazione espressa mostri una maggioranza per uno qualsiasi dei candidati, il Presidente designa l’ora e il luogo per una ulteriore votazione.

Prima della seconda votazione, il candidato che ha avuto il voto più basso alla prima votazione viene eliminato; e ad ogni successiva votazione viene seguita la stessa procedura  fino a quando un candidato non abbia ricevuto la maggioranza dei voti validi espressi.

Non sono permessi voti per delega o di assenti. In caso di parità di voti tra i candidati viene considerato eletto quello con una maggiore anzianità kiwaniana.

 Sezione 11

Il Comitato per le Elezioni riferisce prontamente alla Convention i risultati della votazione ed il verbale viene firmato dalla maggioranza del Comitato. Dopo che il Comitato ha fatto il suo rapporto, il chairman consegna tutte le schede al Segretario affinché siano conservate per un periodo di novanta giorni dopo la chiusura della Convention; dopodiché le schede vengono distrutte.
